Q:  I’ve been involved in a car accident, what do I do?

A:  If you have been in a car accident, it is important that you remain at the scene. It is also important to collect the names, phone numbers, addresses, the car makes and models, drivers’ license and license plate numbers, and any insurance information from those involved in the accident, and from any witnesses to the accident.  Take pictures at the scene with your phone or camera to document any evidence such as vehicle damage, skid marks, or road obstructions.  You also may want to draw a diagram of the accident while still at the scene so that you can better remember the facts and circumstances that led to the accident.

Q:  If and when law enforcement arrives at the scene, should I talk to them?

A:  Yes, you probably should speak with them.  Talk to them about the accident and what you recall, but be sure to avoid taking the blame for the accident and avoid making any accusations.

Q:  Should I report the car accident?

A:  Yes.  You may need to call the local police or California Highway Patrol if someone is injured or dies in the accident, but you should also report the accident to your insurance company.  You may also have to report the accident to the California Department of Motor Vehicles within ten days of the accident if the damage to either car is more than $750, or anyone was injured or died in the accident.

Q:  When should I consult with a lawyer after the accident?

A:  The sooner, the better, especially if you or someone involved was severely injured or death occurred as a result of the accident.  When you speak with an attorney soon after the accident, the details of the accident are fresher in your mind, and more evidence is likely to be preserved.  Moreover, an attorney can provide guidance regarding your medical care and medical expenses if you’re still being treated by a physician.  An attorney can also provide guidance when it comes to dealing with insurance claims.

Q:  When should I notify my insurance company that I’ve been in an accident?
